According to the Principle of Alternative Possibilities, an agent is morally responsible for an action of hers only if she could have done otherwise. The notion of a robust alternative plays a prominent role in recent attacks on PAP based on so-called Frankfurt cases. In this paper I defend the truth of PAP for blameworthy actions against Frankfurt cases recently proposed by Derk Pereboom and David Widerker. My defence rests on some intuitively plausible principles that yield a new (...) understanding of the concept of a robust alternative. As philosophical and scientific arguments for free will skepticism continue to gain traction, we are likely to see a fundamental shift in the way people think about free will and moral responsibility. Such shifts raise important practical and existential concerns: What if we came to disbelieve in free will? What would this mean for our interpersonal relationships, society, morality, meaning, and the law? What would it do to our standing as human beings? Would it cause nihilism and despair as some (...) maintain or would it rather have a humanizing effect on our practices and policies, freeing us from the negative effects of belief in free will? In this chapter we consider the practical implications of free will skepticism and argue that life without free will and basic desert moral responsibility would not be as destructive as many people believe. We argue that prospects of finding meaning in life or of sustaining good interpersonal relationships, for example, would not be threatened. On treatment of criminals, we argue that although retributivism and severe punishment, such as the death penalty, would be ruled out, preventive detention and rehabilitation programs would still be justified. While we will touch on all these issues below, our focus will be primarily on this last issue. -/- We begin in section I by considering two different routes to free will skepticism. The first denies the causal efficacy of the types of willing required for free will and receives its contemporary impetus from pioneering work in neuroscience by Benjamin Libet, Daniel Wegner, and John-Dylan Haynes. The second, which is more common in the philosophical literature, does not deny the causal efficacy of the will but instead claims that whether this causal efficacy is deterministic or indeterministic, it does not achieve the level of control to count as free will by the standards of the historical debate. We argue that while there are compelling objections to the first route—e.g., Al Mele (2009), Eddy Nahmias (2002, 2011), and Neil Levy (2005)—the second route to free will skepticism remains intact. In section II we argue that free will skepticism allows for a workable morality, and, rather than negatively impacting our personal relationships and meaning in life, may well improve our well-being and our relationships to others since it would tend to eradicate an often destructive form of moral anger. In section III we argue that free will skepticism allows for adequate ways of responding to criminal behavior—in particular, incapacitation, rehabilitation, and alternation of relevant social conditions—and that these methods are both morally justified and sufficient for good social policy. We present and defend our own preferred model for dealing with dangerous criminals, an incapacitation account built on the right to self-protection analogous to the justification for quarantine (see Pereboom 2001, 2013, 2014a; Caruso 2016a), and we respond to recent objections to it by Michael Corrado and John Lemos. This Element examines the concept of moral responsibility as it is used in contemporary philosophical debates and explores the justifiability of the moral practices associated with it, including moral praise/blame, retributive punishment, and the reactive attitudes of resentment and indignation. After identifying and discussing several different varieties of responsibility-including causal responsibility, take-charge responsibility, role responsibility, liability responsibility, and the kinds of responsibility associated with attributability, answerability, and accountability-it distinguishes between basic and non-basic desert conceptions of moral responsibility and considers a (...) number of skeptical arguments against each. It then outlines an alternative forward-looking account of moral responsibility grounded in non-desert-invoking desiderata such as protection, reconciliation, and moral formation. It concludes by addressing concerns about the practical implications of skepticism about desert-based moral responsibility and explains how optimistic skeptics can preserve most of what we care about when it comes to our interpersonal relationships, morality, and meaning in life. Much of the recent philosophical discussion about free will has been focused on whether compatibilists can adequately defend how a determined agent could exercise the type of free will that would enable the agent to be morally responsible in what has been called the basic desert sense :5–24, 1994; Fischer in Four views on free will, Wiley, Hoboken, 2007; Vargas in Four views on free will, Wiley, Hoboken, 2007; Vargas in Philos Stud, 144:45–62, 2009). While we agree with (...) Derk Pereboom and others that the compatibilist’s burden should be properly understood as providing a compelling account of how a determined agent could be morally responsible in the basic desert sense, the exact nature of this burden has been rendered somewhat unclear by the fact that there has been no definitive account given as to what the basic desert sense of moral responsibility amounts to. In Sect. 1 we set out to clarify the compatibilist’s burden by presenting our account of basic desert moral responsibility—which we call retributivist desert moral responsibility for purposes of clarity—and explain why it is of central philosophical and practical importance to the free will debate. In Sect. 2 we employ a thought experiment to illustrate the kind of difficulty that compatibilists of any stripe are likely to encounter in attempting to explain how determined agents can exercise the kind of free will needed for retributivist desert moral responsibility. At least some serial killers are psychopathic serial killers. Psychopathic serial killers raise interesting questions about the nature of evil and moral responsibility. On the one hand, serial killers seem to be obviously evil, if anything is. On the other hand, psychopathy is a diagnosable disorder that, among other things, involves a diminished ability to understand and use basic moral distinctions. This feature of psychopathy suggests that psychopathic serial killers have at least diminished responsibility for what they do. In this (...) chapter I consider whether psychopathic serial killers might be properly said to be both evil and morally responsible for their actions. I argue that psychopathic serial killers are plausibly evil in at least one recognizable sense of the term, but that they are nevertheless not likely to be responsible for many of the evils they perpetuate. Examines the relevance of empirical studies of responsibility judgments for traditional philosophical concerns about free will and moral responsibility. We argue that experimental philosophy is relevant to the traditional debates, but that setting up experiments and interpreting data in just the right way is no less difficult than negotiating traditional philosophical arguments. Derk Pereboom’s Free Will, Agency and Meaning in Life (Oxford, Oxford University Press, 2014, pp. 219) follows quite closely in the steps of his Living Without Free Will (2001). Pereboom argues for “hard incompatibilism” in both – the thesis that regardless of whether determinism is true, the kind of free will required for desert-entailing moral responsibility is unlikely to exist. In Free Will…, however, he pays more attention to issues other than moral responsibility. This, I think, is (...) a great strength of the book. It has furthermore been suggested that Free Will… differs from Living… in being less radical; that Pereboom’s hard incompatibilism has softened up over the years. I believe this view is mistaken. It is true that Free Will… contains several passages where Pereboom writes that he is happy to take on board important elements of moral responsibility theories usually labelled “compatibilist”. However, Living… never states the contrary position. Living, rather, has a different focus – on other sceptical views, and how they differ from Pereboom’s own. (shrink)

Within the United States, the most prominent justification for criminal punishment is retributivism. This retributivist justification for punishment maintains that punishment of a wrongdoer is justified for the reason that she deserves something bad to happen to her just because she has knowingly done wrong—this could include pain, deprivation, or death. For the retributivist, it is the basic desert attached to the criminal’s immoral action alone that provides the justification for punishment. This means that the retributivist position is not reducible (...) to consequentialist considerations nor in justifying punishment does it appeal to wider goods such as the safety of society or the moral improvement of those being punished. A number of sentencing guidelines in the U.S. have adopted desert as their distributive principle, and it is increasingly given deference in the “purposes” section of state criminal codes, where it can be the guiding principle in the interpretation and application of the code’s provisions. Indeed, the American Law Institute recently revised the Model Penal Code so as to set desert as the official dominate principle for sentencing. And courts have identified desert as the guiding principle in a variety of contexts, as with the Supreme Court’s enthroning retributivism as the “primary justification for the death penalty.” While retributivism provides one of the main sources of justification for punishment within the criminal justice system, there are good philosophical and practical reasons for rejecting it. One such reason is that it is unclear that agents truly deserve to suffer for the wrongs they have done in the sense required by retributivism. In the first section, I explore the retributivist justification of punishment and explain why it is inconsistent with free will skepticism. In the second section, I then argue that even if one is not convinced by the arguments for free will skepticism, there remains a strong epistemic argument against causing harm on retributivist grounds that undermines both libertarian and compatibilist attempts to justify it. I maintain that this argument provides sufficient reason for rejecting the retributive justification of criminal punishment. I conclude in the third section by briefly sketching my public health-quarantine model, a non-retributive alternative for addressing criminal behavior that draws on the public health framework and prioritizes prevention and social justice. I argue that the model is not only consistent with free will skepticism and the epistemic argument against retributivism, it also provides the most justified, humane, and effective way of dealing with criminal behavior. This article identifies a novel challenge to standard understandings of responsibility practices, animated by experimental studies of biases and heuristics. It goes on to argue that this challenge illustrates a general methodological challenge for theorizing about responsibility. That is, it is difficult for a theory to give us both guidance in real world contexts and an account of the metaphysical and normative foundations of responsibility without treating wide swaths of ordinary practice as defective. Hard incompatibilism is a view which asserts that determinism and free will are inconsistent and given the facts of our best sciences determinism is true; and hence, free will does not exist. Not only that, it also claims that if the world were indeterministic and our actions were caused by states or events, still we would lack free will. In this way, it denies the truth of any libertarian account of free will based on event causation. In that sense, this (...) is a hard position. Regarding moral responsibility, this hard incompatibilism claims that human agents are not morally responsible for their actions, unless they are the ultimate originators (agent-causes) of the actions in question. Derk Pereboom has offered an argument in favor of his hard incompatibilism, aka hard determinism, in which he shows four different hypothetical situations (thought experiments, indeed) each of which is aimed to prove that we are not morally responsible for what we do. The argument is, thus, known as four-case argument. In the present paper, Pereboom’s four-case argument is examined and defended. It has been shown here that Pereboom is quite correct, if we consider the true sense of the term ‘moral responsibility.’ This ‘true sense’ of the term “moral responsibility” is considered as the strong sense of moral responsibility in this paper. However, a weak sense of the term “moral responsibility” has also been proposed in this paper. This proposed weak sense of “moral responsibility” can accommodate most of the socially-approved ways of ascriptions of responsibility. And finally, it has been claimed that our general intuition that every event has a cause and we are not the ultimate sources of our actions is true from the strong sense of moral responsibility; and our commonsense intuition that as human beings we are inherently free and responsible for our actions is true from the weak sense of moral responsibility. This essay reconstructs the sophisticated views on free will and determinism of the nineteenth-century Hindu mystic Sri Ramakrishna and brings them into dialogue with the views of three western philosophers—namely, the Scottish Enlightenment philosopher Lord Kames and the contemporary analytic philosophers Saul Smilansky and Derk Pereboom. Sri Ramakrishna affirms hard theological determinism, the incompatibilist view that God determines everything we do and think. At the same time, however, he claims that God, in His infinite wisdom, has endowed ordinary (...) unenlightened people with the illusion of free will for the sake of their moral and spiritual welfare. Kames, I suggest, defends a theological determinist position remarkably similar to Sri Ramakrishna’s. However, I argue that Sri Ramakrishna’s mystical orientation puts him in a better position than Kames to explain why a loving God would implant in us the illusion of free will in the first place. I then show how certain aspects of the views of Smilansky and Pereboom resonate with those of Sri Ramakrishna. (shrink)

Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Este paper busca aportar elementos para el debate de la pérdida de legitimidad del principio de precaución en el derecho colombiano y ante las autoridades públicas. Para demostrar esta premisa, el autor se vale del análisis de la heurística de la disponibilidad y del descuido de la probabilidad, así como del estudio de caso de la tardía aplicación del principio en el Programa de Erradicación de Cultivos de Uso Ilícito mediante aspersión aérea con Glifosato.

La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. El problema del acceso a los medicamentos no obedece siempre al rol cuestionable de la industria farmacéutica, como sí en gran medida a los Estados, responsables inmediatos por el abandono de millones de pacientes en los países bajo el umbral de pobreza y desarrollo. Para evidenciar esta información se plantean tres escenarios en los que las políticas públicas aún tienen una gran tarea pendiente: la ausencia de regulación y vigilancia, la permisividad con prácticas seudocientíficas y el abandono en regiones apartadas. There is a close relationship between education and citizenship. Liberal political theorists tend to spend much of their work justifying the role of educational institutions in political communities. However, the development of these proposals is usually thought for subjects who do not have disabilities, arbitrarily excluding a significant proportion of society. This not only happens at an educational level, it is replicated in various areas of social life. In this sense, in the present work I am going to propose that (...) the adequacy approach proposed by Debra Satz is extremely valuable to think about the educational equity of people with disabilities. The choice is not accidental or arbitrary. Satz is a renowned philosopher whose interest in education and its importance in forming citizens for diverse and plural societies. To do this, I will begin by presenting three possible models of special education: the special school, integration and inclusion. Then the two paradigms that prevail in the characterization of disability will be addressed: the social model and the medical model. Instead, I will reconstruct the third proposal elaborated by Satz in order to evaluate with which inclusive education model and disability paradigm it is compatible and why it is presented as a valuable proposal in this field. Aristóteles establece los principios de la generación en GC 1 pero en adelante construye genuinas demostraciones científicas apoyándose precisamente en aquellos principios. Reconstruiremos un pasaje puntual de GC 2. 10 para defender la hipótesis del uso real de la demostración científica en los tratados científicos. ¿Cuál es la diferencia entre los sentidos de la vista y el tacto si las propiedades espaciales que perciben estos sentidos son, al parecer, las mismas? ¿Cuál es la diferencia entre ver y tocar formas? Este es el tema del artículo “Sight and touch” (1992) de Michael Martin. En este breve texto, es mi propósito concentrarme en algunos desarrollos de Martin sobre el sentido del tacto y poner esos desarrollos en relación con dos experiencias táctiles particulares. La idea principal en (...) la que quiero concentrarme es la del contraste interno-externo como la característica de la conciencia corporal que “proporciona lo que necesitamos para un sentido del tacto” (Martin 1992 203). Las experiencias táctiles particulares con las que quiero relacionar esta idea son la de la ingesta de alimentos y el estar anestesiado. Pretendo ver si estas experiencias pueden constituir algún tipo de objeción a dicho contraste interno-externo. // What is the difference between the senses of sight and touch, if the spatial properties perceived by these senses are apparently the same ones? What is the difference between seeing and touching shapes? This is the subject matter of Michael Martin’s article “Sight and touch” (1992). In this short text, my purpose is to focus on some of Martin’s developments on the sense of touch, and to put those developments in relation with two tactile experiences. The main idea I want to focus on is that of the inner-outer contrast as the characteristic of body consciousness that “provides what we need for a sense of touch” (Martin 1992 203). The tactile experiences with which I want to relate this idea are those of food intake and being anesthetized. “Structuralism, Fictionalism, and the Applicability of Mathematics in Science”. This article has two objectives. The first one is to review some of the most important questions in the contemporary philosophy of mathematics: What is the nature of mathematical objects? How do we acquire knowledge about these objects? Should mathematical statements be interpreted differently than ordinary ones? And, finally, how can we explain the applicability of mathematics in science? The debate that guides these reflections is the one between mathematical realism and (...) anti-realism. On the other hand, the second objective is to discuss the arguments that use the applicability of mathematics in science to justify mathematical realism, and show that none of them reaches its aim. To this end, we will distinguish three aspects of the problem of the applicability of mathematics: the utility of mathematics in science, the unexpected utility of some mathematical theories, and the apparent indispensability of mathematics in our best scientific theories - in particular, in our best scientific explanations. Finally, I argue that none of these aspects constitutes a reason to adopt mathematical realism. (shrink)

Este artículo aborda, desde la relectura del trabajo de Alfred Schütz “La ejecución musical conjunta” (“Makingmusictogether”), la idea de intersubjetividad como sintonía en las relaciones sociales explorando en los elementos señalados por el autor, como la dimensión temporal, el cara a cara y la sincronización con el Otro. Se abre así una posibilidad de comprensión de los procesos intersubjetivos, en la perspectiva del reconocimiento de la alteridad (Levinas) como constitutiva de intersubjetividad, y se plantea la pregunta de si es posible, (...) en contextos de exclusión, avanzar hacia la constitución de sintonía entre sociedad y Estado. Entre el arte y la literatura se han generado múltiples reflexiones que han sido estudiadas por la historia del arte, la teoría literaria y la estética, entre otros. Igualmente, podemos considerar una larga tradición de artistas y escritores que se han empeñado, por medio de ensayos, críticas y manifiestos, en considerar los ámbitos y lugares de competencia de cada forma artística, así como sus lugares de similitud y diferencia en una larga tradición de préstamos interartísticos entre la palabra y la (...) imagen. En el seno de esta discusión, se quiere analizar el diálogo disciplinar entre la literatura y el arte que se da en torno a la figura del pintor post impresionista Paul Gauguin y el escritor Mario Vargas Llosa. Para ello, reflexionamos a partir de una de las obras fundamentales del pintor francés, que tiene su correspondencia y complementariedad en la obra literaria del escritor peruano. De esta manera, se presenta una revisión de una fuente literaria que propone no solo una alusión temática a la obra del pintor, sino que se enmarca bajo coordenadas estéticas, que superan los armazones de las teorías o historias meramente literarias. En el pensamiento de Santo Tomás de Aquino, la Filosofía Moral y la Teología Moral tienen al bien como concepto central, es decir, el ser en cuanto apetecible y en cuanto fin de la tendencia o apetito. Lo anterior es debido a que lo bueno expresa el en cuanto se relaciona con el apetito y de este modo señala la capacidad del ser para mover la voluntad o una tendencia cualquiera hacia su fin. Es por esto que Santo Tomás sostiene (...) con Aristóteles que el bien coincide con la noción de fin. Y es por la importancia de estos principios y por la repercusión en la moral y sobretodo en la explicación de la libertad moral, que este breve trabajo consiste en una profundización en las relaciones entre el bien, el fin y la naturaleza y algunas de sus aplicaciones a lo que se conoce como tendencia natural o apetito natural y la tendencia libre que se refiere a la voluntad sobre todo a la voluntad de la persona humana. No se trata de un intento por presentar todas las conclusiones que de estos principios se siguen, lo cual correspondería a la Filosofía o a la Teología Moral, sino más bien de una profundización en los principios metafísicos, para asentar los cimientos del orden moral. -/- In the thought of St. Thomas Aquinas, both ethics and moral theology have as their central concept of the good, that is, of being insofar as it is desirable and insofar as it is the end of appetitive tendencies. This is due to the fact that the good expresses being insofar as it relates to the appetite, and thus it expresses the capacity of being to move the will, or to any tendency towards its end. For this reason St. Thomas holds with Aristotle that the good is convertible with the notion of end. And it is due tuo the importance of these principles and their consequences for morality and moral freedom that in this brief work I attempt to delve into the relationship between the good, the end, and nature, and some of its applications to what is known as natural tendency or natural appetite as well as to the free tendency which is called "the will", especially the will of the huma person. It is not an attempt to present all the conclusions that follow form these principles -a task that would correspond to ethics or to moral theology- but attempt to delve into the metaphysical principles that ground the moral order. El presente artículo busca establecer el origen y desarrollo del concepto de ley natural en Tomás de Aquino, especialmente la relación que se establece entre razón y voluntad. Recordemos que esta relación ha sido objeto de numerosos estudios, especialmente en referencia al mismo concepto en Francisco Suárez. El artículo trata el tema de manera objetiva y como testigo de lo que nuestro teólogo pensó y estableció en sus escritos. El presente capítulo analiza las empresas como organizaciones que poseen un clima y una atmósfera propias de acuerdo con su funcionamiento, en las cuales se dinamizan actividades y productos desarrollados en el tiempo. En este orden de ideas, el problema de los impactos del sector empresarial al cambio climático, no es de la industria o de las organizaciones empresariales per se sino de los modelos antrópicos, o de las ontologías dualistas de la sociedad occidental, que solo conciben el mundo como (...) una autorreferencia contenida, en la que la posición y el bienestar de otros actores no se tienen en cuenta, y solo se concibe la oportunidad de producción y consumo para un solo actor. De este modo, la propuesta que realizan los autores, toma en cuenta referentes de equilibrio y bienestar basados en las formas de vida y en las ontologías que representan dichos movimientos sociales desde el sur global. Estos modelos se destacan porque la subsistencia se asume como un proceso de relación antes que uno de dominación y acaparamiento de los recursos disponibles, y es desde este sentido que se convierten en alternativas ecológicas con un profundo énfasis en el reconocimiento de la diversidad y las necesidades del otro. Este paper examina en detalle el marco constitucional dispuesto en 1991 para la protección del medio ambiente y la configuración del Estado colombiano frente a los nuevos retos que plantea la protección ambiental. Lo anterior, a partir de dos elementos claves para entender el papel de los mecanismos jurídicos en la defensa de la naturaleza y el ambiente: la participación ambiental y el acceso a la justicia ambiental, ello, con el fin de conocer los instrumentos que reconfiguran el Estado para (...) que la ciudadanía y las organizaciones sociales puedan ejercer una defensa jurídica del medio ambiente, que aporte a la construcción de la justicia ambiental. El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

En el presente artículo se reflexiona sobre dos propuestas de Arturo Andrés Roig: la conciencia de la alteridad y el a priori antropológico para reconocer sus posibilidades de cara al progreso de la ideas y programas filosóficos. Para ello, se muestran las insuficiencias y posibilidades. Las primeras emergen al adoptar uno de los principios más importantes que sostienen el programa filosófico de la modernidad: el mantenimiento del ser humano como fundamento del mundo.
